The IRS’ own internal IT guidelines require 7 years of audit log retention. Those audit logs would be enough to track the entire life-cycle of Lerner’s emails, from the time of first backup, down to the time of destruction. If those emails were permanently deleted, there would be a complete audit log showing all of that information.
